1. Acceptance of these Terms
These Terms of Use (“Terms”) are an agreement between you and Vadym Teslia (“PingArray,” “we,” “us,” or “our”) concerning your use of the PingArray iOS application and the website at pingarray.teslia.me.
By downloading, accessing, or using PingArray, you agree to these Terms. If you do not agree, do not use PingArray. These Terms apply only to the extent permitted by applicable law and do not limit any consumer rights that cannot legally be waived.
2. Apple Standard EULA
When you obtain PingArray through Apple’s App Store, the license to the app is governed by Apple’s Licensed Application End User License Agreement (“Standard EULA”). These Terms supplement the Standard EULA with rules specific to PingArray and its website; they do not replace it.
If these Terms conflict with the Standard EULA, Apple’s applicable usage rules, or non-waivable rights under applicable law, those other terms or rights control to the extent of the conflict.
3. Eligibility
PingArray is a general-audience network utility and is not directed to children. You must be legally capable of agreeing to these Terms. If you are below the age at which you can enter into a binding agreement where you live, you may use PingArray only with the permission and supervision of a parent or legal guardian who accepts these Terms.
4. Permitted Use
Subject to these Terms and the Standard EULA, you may use PingArray on compatible Apple devices for your own lawful network-diagnostic purposes, including personal use and internal professional or business use.
The app is licensed, not sold. Except where applicable law expressly permits it, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, attempt to extract source code from, or create derivative works of PingArray.
5. Network Probes and Public Services
PingArray sends ICMP, TCP, or HTTP requests to destinations you select, including hosts you specify directly and any public services or well-known endpoints made available through the app, for example public DNS resolvers, gaming or communication platform hosts, and CDN endpoints. You decide what to test, and you are responsible for ensuring that your use is lawful and consistent with applicable contracts, network policies, rate limits, and the destination operator’s terms of service.
The fact that a host, IP address, or service appears in PingArray, whether added by you, suggested by the app, or included in a built-in list of common public services, does not mean that it is pre-authorized for monitoring or automated testing. Many operators tolerate light diagnostic traffic but may restrict automated probing or high-frequency checks. Before running sustained or frequent tests, you should review and follow the destination’s usage policies.
You should only probe systems and services in ways that you are allowed to use them. Having legal control over a system, having the operator’s permission, or staying within their published acceptable-use and rate-limit policies are examples of authorized use.
You must not use PingArray to:
- attempt to gain unauthorized access to systems or data;
- disrupt, degrade, overload, or deny service to a network or host;
- harass, threaten, abuse, stalk, or harm another person or organization;
- evade access controls, security restrictions, rate limits, or usage policies;
- send unlawful, deceptive, malicious, or excessively frequent traffic; or
- assist any activity that violates applicable law or another party’s rights.
Use reasonable probe intervals and volumes. If an operator asks you to stop testing their service, if their terms prohibit the type of monitoring you are performing, or if your traffic causes unexpected load or disruption, you should stop using PingArray against that destination.
PingArray and its developer are not responsible for your choice of targets or for any consequences of probing those targets, including public services included or suggested within the app. You assume full responsibility for complying with legal, contractual, and policy requirements when you use PingArray’s testing features.
6. User-Selected Targets and Device Costs
You control the hostnames and IP addresses you add, the probe method, and the polling interval. You are responsible for the accuracy of that information and for any activity generated by your configuration.
PingArray uses your device’s internet or local-network connection. Your carrier, internet provider, employer, or network operator may charge fees or impose restrictions. You are responsible for those charges and for complying with those restrictions.
7. Diagnostic Results
PingArray reports measurements observed from your device at a particular time. Results can be affected by Wi-Fi conditions, routing, congestion, firewalls, device state, destination behavior, protocol differences, and other factors outside PingArray’s control.
Measurements, charts, quality labels, and availability indications are estimates provided for general informational and troubleshooting purposes. They are not a service-level guarantee, security assessment, proof of an outage, or professional advice. Do not rely on PingArray as the sole basis for emergency, safety-critical, medical, financial, legal, or other high-risk decisions.
8. Third-Party Services and Destinations
PingArray can communicate with Apple services, built-in public destinations such as Cloudflare, Google, and Quad9, and destinations you add. It may also link to third-party websites. These services are independent from PingArray and are governed by their own terms and policies.
We do not control or endorse user-selected destinations and are not responsible for their availability, accuracy, content, security, privacy practices, or actions. A third party may change, restrict, or discontinue its service at any time.

9. Intellectual Property
PingArray, including its software, design, text, graphics, branding, and other original content, is owned by Vadym Teslia or the applicable licensors and is protected by intellectual-property laws. These Terms and the Standard EULA give you only the limited rights expressly described in them.
Apple, App Store, and related marks belong to Apple Inc. Other names and marks belong to their respective owners.
10. Updates, Availability, and Changes
PingArray may be updated to add, change, or remove features; address security or reliability issues; maintain compatibility; or comply with legal requirements. No promise is made that any particular feature, destination, platform version, or service will always remain available.
You are responsible for installing available updates where reasonably necessary for security, compatibility, or continued operation. Some updates may be provided under additional or revised terms, which will be presented or published as required.
11. Suspension and Termination
You may stop using PingArray at any time and remove it from your device. Your rights under these Terms end if you materially breach them. Where technically and legally available, access to developer-operated features or services may be restricted to protect users, networks, rights holders, or PingArray, or to comply with law.
Sections that by their nature should continue after termination, including intellectual property, disclaimers, liability limitations, and general terms, will survive.
12. Disclaimers
To the maximum extent permitted by applicable law, PingArray and the website are provided “as is” and “as available,” with all faults and without warranties of any kind. Implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement are disclaimed to the extent those warranties may lawfully be disclaimed.
No warranty is made that PingArray will be uninterrupted, error-free, secure, compatible with every network, or able to reach or accurately measure every destination. Nothing in these Terms excludes an express warranty or statutory consumer protection that cannot lawfully be excluded.
13. User Responsibility and Assumption of Risk
You are solely responsible for the destinations you choose to test, the probe methods you enable, the frequency and duration of your tests, and your compliance with applicable laws, contracts, network policies, rate limits, and third-party terms.
By using PingArray’s testing features, you understand and accept that network probes may be unwanted, restricted, or interpreted differently by destination operators, network providers, employers, or other third parties. You assume all risks arising from your testing activity, including service restrictions, rate limiting, network complaints, account consequences, or other claims related to the targets you select.
PingArray is a general-purpose diagnostic tool. It does not grant you any right to access, monitor, or test any network, host, or service, and it does not verify whether your intended use is permitted. You are responsible for making that determination before starting any test.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Vadym Teslia will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of profits, revenue, business, opportunity, goodwill, or data, arising from or related to PingArray, the website, a network probe, or a third-party destination.
Where liability may lawfully be limited, total aggregate liability arising from these supplemental Terms will not exceed the greater of the amount you paid for PingArray during the twelve months before the event giving rise to the claim or USD $50. The Standard EULA’s allocation of liability remains unaffected.
These limitations do not apply to fraud, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.
15. Changes to These Terms
These Terms may be revised when PingArray’s features, risks, or legal obligations change. Revised Terms will be posted on this page with a new “Last updated” date. If a change is material and there is a practical way to notify users, additional notice may be provided.
Your continued use after revised Terms become effective constitutes acceptance to the extent permitted by applicable law. If you do not agree to revised Terms, stop using PingArray.
16. General
These Terms supplement the Standard EULA and, together with the documents they expressly incorporate, form the agreement concerning the subjects they cover. They do not create rights for third parties except where the Standard EULA provides otherwise.
If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. Nothing in these Terms selects a governing law or court or requires arbitration; applicable law determines those matters.
